Service Description
Kansas Pest Control provides residential and commercial pest management services throughout the state of Kansas. Our services include inspection, identification, treatment, and ongoing monitoring of various pests including but not limited to rodents, insects, termites, bed bugs, ants, spiders, cockroaches, and wildlife. Treatment methods may involve chemical applications, baiting systems, trapping, exclusion techniques, and integrated pest management approaches. The specific services provided will be detailed in your individual service agreement or work order. Service frequency, coverage areas, and treatment specifications vary based on property conditions, pest pressure, seasonal factors, and the terms of your selected service plan. We reserve the right to modify treatment protocols based on our professional assessment of each situation. All services are performed by licensed technicians in accordance with Kansas Department of Agriculture regulations and applicable federal guidelines governing pesticide use and pest control operations.
No Guarantee or Warranty
Kansas Pest Control does not guarantee complete elimination of pests from your property. Pest management results depend on numerous factors outside our control, including but not limited to: surrounding environmental conditions, neighboring property infestations, structural integrity of buildings, weather patterns, client cooperation with preparation and follow-up instructions, and the biological characteristics of target pest species. We do not warrant that our services will prevent future infestations or that treated areas will remain pest-free for any specific duration. Any statements about expected outcomes represent our professional estimates based on experience and industry standards, not guarantees of performance. Our obligation is to apply treatments using methods consistent with professional pest control practices; we cannot promise specific results. Termite treatments and damage repair warranties, if offered, are governed by separate written agreements with specific terms, conditions, and limitations clearly stated therein.
User Responsibilities
As a customer of Kansas Pest Control, you agree to fulfill certain obligations to facilitate effective service delivery. You must provide accurate information about your property, existing pest conditions, prior treatments, and any health concerns or sensitivities of occupants including pets. You are responsible for preparing areas as instructed before scheduled treatments, which may include removing food items, covering fish tanks, securing pets, clearing access to treatment areas, and vacating premises for specified periods when required. You must notify us of any changes to property conditions, new pest activity between scheduled visits, or if instructed preparation steps cannot be completed. Failure to follow preparation instructions may result in service delays, additional charges, or reduced treatment effectiveness for which we assume no responsibility. You agree not to interfere with or remove bait stations, monitoring devices, or other installed equipment without prior authorization. Payment obligations must be met according to agreed terms; delinquent accounts may result in service suspension.
Limitation of Liability
To the fullest extent permitted by Kansas law, Kansas Pest Control's liability arising from or related to our services is strictly limited. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to property damage, loss of profits, personal injury beyond direct physical harm caused by our negligence, or emotional distress. Our total cumulative liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve months preceding the incident. We are not responsible for damage to personal property, landscaping, or structural elements unless directly caused by our gross negligence and documented within forty-eight hours of service completion. We assume no liability for allergic reactions, chemical sensitivities, or health conditions aggravated despite proper application methods and label-compliant product use. This limitation applies regardless of whether claims are based in contract, tort, strict liability, or any other legal theory.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and intellectual property associated with Kansas Pest Control are our exclusive property or used under proper license. This includes our website content, marketing materials, service documentation, treatment protocols, custom bait formulations, inspection reports, and proprietary business methods. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any of our intellectual property without express written permission. Service reports and documentation provided to you are intended for your personal reference and insurance or real estate transaction purposes only; unauthorized commercial use, resale, or distribution of our reports is prohibited. Feedback or suggestions you provide may be used by us without obligation or compensation. We respect third-party intellectual property rights and expect the same from our customers regarding any materials you provide to us.
Governing Law
These Terms of Service and any disputes arising from your relationship with Kansas Pest Control shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these terms or our services shall be brought exclusively in the state or federal courts located in Sedgwick County, Kansas, or the county of your residence if jurisdiction permits. You consent to the personal jurisdiction and venue of such courts. If any provision of these terms is found invalid or unenforceable under Kansas law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is impossible, severed from these terms, with all remaining provisions continuing in full force. The parties waive any right to trial by jury in any action or proceeding related to these terms or our services.
Changes to Terms
Kansas Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective immediately upon posting to our website or, for active customers, upon reasonable notification through email, mail, or inclusion with service documentation. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. Material changes affecting your rights or obligations will be communicated with at least thirty days' advance notice when practicable. If you do not agree with modified terms, you must discontinue service and notify us in writing before the effective date of changes. Previous versions of these terms are available upon request. No oral modifications or waivers of any provision shall be valid or enforceable.
